Welcome to MIKUN

MIKUN is New Zealand's destination for authenticated pre-owned luxury goods.

These Terms of Sale, Website Use & Consignment Conditions ("Terms") govern your access to and use of the MIKUN website, products, services, authentication services, consignment services and all related interactions with MIKUN.

Throughout these Terms, "MIKUN", "we", "our" and "us" refer to MIKUN.

By accessing our website, creating an account, submitting an enquiry, consigning an item, making an offer, purchasing a product or otherwise using our services, you agree to be bound by these Terms together with our:

  • Privacy Policy

  • Returns & Refund Policy

  • Authentication Guarantee

  • Shipping & Delivery Policy

If you do not agree to these Terms, you should not use our website or services.

Consumer Rights

Nothing in these Terms excludes, restricts or modifies any rights or remedies available under:

  • Consumer Guarantees Act 1993 (New Zealand)

  • Fair Trading Act 1986 (New Zealand)

  • Privacy Act 2020 (New Zealand)

  • Any other applicable legislation

Where goods are acquired for personal, domestic or household use, consumers may be entitled to remedies under applicable law.

Where goods or services are acquired for business purposes, and where permitted by law, the parties agree that the Consumer Guarantees Act 1993 shall not apply.

Nature of Pre-Owned Luxury Goods

MIKUN specialises in authenticated pre-owned luxury goods.

Unless expressly stated otherwise, all products offered for sale are pre-owned and may display signs of prior ownership consistent with age, use and storage.

Customers acknowledge that:

  • Pre-owned luxury goods are unique and one-of-a-kind.

  • Signs of wear may be present.

  • Leather, hardware, stitching and materials naturally age over time.

  • Minor imperfections may not be visible in every photograph.

  • Variations in colour may occur due to lighting and screen settings.

Customers are encouraged to review all photographs, measurements and descriptions carefully before purchase.

Condition Grading

Condition assessments reflect MIKUN's opinion using industry-standard grading practices.

Condition grading is inherently subjective.

Reasonable differences in personal opinion regarding condition, wear, appearance, colour, patina or ageing shall not, by themselves, constitute a defect, misrepresentation or basis for return.

Product photographs and written condition descriptions form part of the product listing and should be considered together.

Authentication

Authenticity is fundamental to MIKUN.

Every item offered for sale undergoes an authentication process prior to listing.

Authentication may include:

  • Specialist review;

  • Entrupy authentication technology;

  • Independent third-party authentication services;

  • Serial number and date code verification;

  • Construction and material analysis;

  • Provenance assessment;

  • Supporting documentation review.

Authentication assessments represent MIKUN's professional opinion based on information available at the time of assessment.

MIKUN reserves the right to:

  • Accept or reject any item;

  • Request further information;

  • Remove any item from sale;

  • Re-authenticate any item at any time.

Nothing in these Terms limits any rights available under applicable law.

Customers should also refer to MIKUN's Authentication Guarantee.

Authentication Guarantee

MIKUN stands behind the authenticity of every item sold through the platform.

Should a credible authenticity concern arise, MIKUN reserves the right to undertake further review using internal specialists, Entrupy technology and/or independent authentication providers.

Any authenticity claim must be supported by credible evidence and submitted in accordance with MIKUN's Authentication Guarantee and Returns & Refund Policy.

Nothing in this clause excludes any rights available under applicable law.

Market Value Disclaimer

Any reference to:

  • Retail Price

  • Recommended Retail Price (RRP)

  • Original Retail Price

  • Market Value

  • Estimated Value

  • Comparable Sales

is provided for informational purposes only.

Such information does not constitute:

  • Financial advice;

  • Investment advice;

  • Insurance valuation;

  • Future resale value guarantee.

Luxury resale values fluctuate based on market conditions, brand performance, rarity, demand and buyer behaviour.

MIKUN makes no representation regarding future resale value, appreciation or investment performance.

Force Majeure

MIKUN shall not be liable for any delay, interruption or failure to perform its obligations where such delay, interruption or failure arises from events beyond its reasonable control.

This includes, but is not limited to:

  • Natural disasters;

  • Floods;

  • Earthquakes;

  • Pandemics;

  • Government actions;

  • Transport disruptions;

  • Industrial action;

  • Cyber incidents;

  • Telecommunications failures;

  • Third-party service provider failures.

Consignment Ownership Warranty

By submitting an item to MIKUN for sale, the Consignor warrants and represents that:

  • They are the lawful owner of the item;

  • They have full authority to sell the item;

  • The item is authentic;

  • The item has not been obtained through fraud;

  • The item has not been reported lost or stolen;

  • The item is free from finance, security interests, liens and encumbrances;

  • No third party has any ownership claim over the item;

  • The item is not subject to any legal dispute;

  • All information supplied to MIKUN is accurate and complete.

The Consignor acknowledges that MIKUN relies upon these warranties when accepting an item for authentication, valuation or sale.

Identity Verification

To protect customers, consignors and the integrity of the MIKUN marketplace, MIKUN reserves the right to verify the identity of any consignor.

MIKUN may request:

  • Passport;

  • Driver Licence;

  • Proof of Address;

  • Banking Verification;

  • Ownership Documentation;

  • Any other information reasonably required to verify identity and ownership.

MIKUN may refuse, suspend or terminate a consignment arrangement where verification requirements are not satisfied.

Counterfeit & Misrepresented Goods

MIKUN maintains a zero-tolerance policy regarding counterfeit, altered or misrepresented goods.

Where MIKUN reasonably suspects that an item may be counterfeit, altered, tampered with or materially misrepresented, MIKUN reserves the right to:

  • Reject the item;

  • Remove the item from sale;

  • Refuse future consignments;

  • Retain authentication records;

  • Cooperate with law enforcement or regulatory authorities where legally required.

The Consignor agrees to indemnify MIKUN for any loss, liability, cost, expense, claim or reputational damage arising from the submission of counterfeit or misrepresented goods.

No Guarantee of Sale

Submission of an item to MIKUN does not guarantee:

  • Acceptance for sale;

  • Sale within a particular timeframe;

  • Sale at a particular price;

  • Achievement of estimated market value.

Luxury resale markets fluctuate and customer demand cannot be guaranteed.

Limitation of Liability

To the maximum extent permitted by law, MIKUN shall not be liable for:

  • Indirect loss;

  • Consequential loss;

  • Loss of profits;

  • Loss of opportunity;

  • Loss of goodwill;

  • Market value fluctuations;

  • Third-party actions beyond MIKUN's reasonable control.

Nothing in these Terms excludes rights that cannot be excluded under New Zealand law.

Governing Law

These Terms are governed by the laws of New Zealand.

Any dispute arising from these Terms, the MIKUN website or any transaction with MIKUN shall be subject to the exclusive jurisdiction of the courts of New Zealand.
